This Privacy Policy describes how Ecash Software B.V. and its subsidiaries and affiliates (collectively “Ecash Software”, “we”, “us” and/or “our”) collects and manages your personal information (i.e., any information that relates to an identified or identifiable individual) as part of providing our Services (defined below).

1. Interpretation

This privacy policy applies only to the following persons (collectively “you” or “your”):

Visitors

means any person who contacts Ecash Software B.V, speaks with a Ecash Software B.V sales representative, or provides feedback (e.g. responds to a survey), any person who visits www.ecashcloud.com, as well as any other Ecash Software B.V applications or websites that Ecash Software B.V uses and where a link to this Privacy Policy is included, such as websites created for contests or promotional purposes (the “Websites”);

Customers

means any business owner or business that subscribes to the Ecash Software B.V software services or otherwise purchases services from Ecash Software B.V (the “Services”), either through a paid subscription or a trial; and

Partners

means Ecash Software B.V.’s third-party business partners, including their employees and representatives.

2. Information that we collect from you

A. Personal Data that we collect directly from you

When you use our Websites or mobile applications to download a whitepaper, request a trial or ask for any other information, you will be asked to provide contact details which we will then use to deliver the requested information and/or service.

When you contact customer support or speak with a sales representative, we may record the call for training purposes and to improve our service.

If you are using or accessing our Services, whether in connection with a paid subscription, a free trial or purchased service, we may ask for specific information, such as your name, address, e-mail address and phone number for us to be able to perform our obligations under the terms of these Services. In addition, we collect your payment details to be able to process the payment of your subscription fee or purchase price.

Customers may provide Personal Data of End-Users and other third parties by inputting that Personal Data into the Services, for example, when they process a transaction. This Personal Data is collected and used in accordance with the Customer’s privacy policy.

B. Information that Ecash Software B.V may collect about you through our Websites and Applications

Technologies Used by us

As part of our Websites, including applications, and Services, we use various technologies such as “session” and “persistent” cookies (small data files that we transfer to your computer), web beacons (tiny image files on web pages that communicate information about the page viewer to the beacon owner), log data, and third-party analytics services, such as Google Analytics, to collect and analyze information about Visitors, Customers, and Partners. Technology is, by its nature, dynamic and ever-changing; the technological tools used today by Ecash Software B.V are therefore subject to modification and replacement in the future.

Session Cookies

We use “session” cookies to keep you logged in while you use our Services, to better understand how you interact with our Services, and to monitor aggregate usage and web traffic information on our Services.

Persistent Cookies

We use “persistent” cookies to recognize you each time you return to our Websites or Services. For example, we create a persistent cookie that includes some basic information about you, like your most recent search. We use this persistent cookie to remember your preferences and, if you create an account, to make your user experience consistent.

Tracking Technologies

Web beacons, tags and scripts may be used on our Websites, our Services, in e-mails or other electronic communications we send to you. These technologies help us in understanding how our Websites and Services are used, what other websites our visitors have visited and when an email is being opened and acted upon so that we can improve our Services.

Log Data

Our servers automatically record information created by your use of the Websites or Services (“Log Data”). Log Data includes information such as your IP address, browser type, operating system, the referring web page, web pages visited, location, your mobile carrier, your computer or mobile device type, search terms and cookie information. We receive Log Data when you interact with our Websites or Services, for example, when you visit our Websites, sign into our Services, or interact with our email notifications.

You may delete or disable certain of these technologies at any time via your browser settings. To opt out of analysis by Google Analytics on our website and other websites, please visit Google’s web page.

C. Information that we Receive from Third Parties

We may sometimes obtain Personal Data about you from third parties (e.g., Facebook, Twitter, Google) and use it to improve or re-market our Services, or to provide a more tailored experience with our Services.

3. How we use personal information

A. Why do we Collect your Personal Data?

Purposes for data processing 

We collect your Personal Data for the following purposes:

  • To send you communications or documents you have requested (such as offers, demonstrations, whitepapers, newsletters and marketing materials);   
  • To contact you to ask you if you have any questions about the Services or information that you have requested from us;
  •  To communicate with you via email, telephone, text (SMS), postal services, social media and websites regarding Ecash Software B.V-related news and inform you about Services that may be of interest to you, if you allow us to do so; To respond to your questions or requests for additional information;
  • To set up a trial or regular account for our Services;
  • To provide our Services to you;
  • To share and exchange reports and information with credit reporting agencies, credit bureaus and/or any other entity connected with the use of our payments processing services; and to use other third party databases (including registries, licensing authorities, identification services, telecom providers) or references provided by you to obtain or verify information about your financial circumstances, background and to identify and detect fraud;
  • To manage our relationship with you and to provide you with customer support;
  • To provide training and quality assurance;
  • To process payments to us or remit payments to you;
  • To get a better understanding of how you browse our Websites so that we can optimize your experience;
  • To research and analyze your use of or interest in our Services and those products and services offered by others;
  • To analyze the effectiveness of our Services;
  • To improve the functionality of our Websites and Services;
  • To help you find the most relevant information by customizing our Services to optimize your experience;
  • To verify your eligibility and deliver prizes in connection with promotions, contests and sweepstakes;
  • To perform any additional purposes explicitly described to you at the time of collection and for which we receive your consent;
  • In connection with a dispute or an investigation in which we are or may become involved either directly with you or with a third party;
  • To manage and protect the security and resilience of the systems, networks and applications that we use to provide our Websites and Services.

B. Do we disclose your Personal Data?

We will only share your Personal Data in accordance with this Privacy Policy. In the following circumstances, we may share your Personal Data with third parties.

Social Network Sharing

When you use any social network sharing function in connection with the Services (for example, sharing on Facebook), your sharing activity will be processed through a third party’s site or service. These third-party privacy policies, not ours, govern the collection and use of the information collected on those sites or networks, including Personal Data.

Protecting Ourselves and our Customers

We may release Personal Data when we believe that doing so is appropriate to comply with applicable laws, regulations or legal requests; to enforce or apply our policies and guidelines; to initiate, render, bill, and collect amounts owed to us; to protect our rights or property; to protect the safety of our Customers; to address fraud, security or technical issues; to prevent or stop activity that we consider to be illegal or unethical; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay. Without limiting the generality of the foregoing, we may also be required to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

4. How do we protect your personal data

We treat your Personal Data as private, confidential information and we strive to ensure that Personal Data under our control, regardless of format, is protected and kept secure at all times. Please be aware, however, that no method of transmitting information over the Internet or of storing information is completely secure. Accordingly, we cannot absolutely guarantee the protection of any information shared with us. In the event of an unauthorized loss or disclosure of Personal Data, Visitors, Partners, and Customers may be subject to a risk of harm resulting from such loss or disclosure. Depending on various factors, such as the type and amount of Personal Data disclosed, consequences for individuals could include changes to their credit bureau rating or financial situation or identity theft. Ecash Software B.V. will at all times comply with applicable laws concerning data breach notification requirements and will endeavor to mitigate any risks of residual harm to the affected individuals.

A. Retention of Personal Data

We retain personal information as long as reasonably necessary to provide the Services, carry out the purposes described in this Statement or as otherwise required in order to comply with our records retention periods (which reflect the applicable law). For example, we may retain information about users of our Services in order to comply with our legal and regulatory obligations or to protect our interests as part of providing the Services. 

5. Your rights and choices

As part of the Services and other processing described in this Statement, we recognize that you may want to update, correct or otherwise manage your personal information that we process as well as manage how Ecash Software B.V communicates with you. This includes communications relevant to the Services or fulfilling a particular interaction with you as well as marketing communications where we have your consent or as otherwise permitted under the applicable law. Depending on the nature of your relationship with Ecash Software B.V, we may provide you with the capability to manage your personal information directly as part of the Services or by contacting Ecash Software B.V.

A. Managing your information

We want to ensure that you have the necessary tools at your disposal to manage your personal information. We rely on you to ensure that your information is accurate, complete and up to date and ask that you notify us of any changes to your personal information. Your ability to update and manage your personal information will differ depending on your relationship with Ecash Software B.V and what Services you use. For example,

  • As a Merchant, for certain services, you may access, change or correct certain account information at any time by logging into your account. In other instances, please contact our customer success team.
  • As a Guest, depending on the Services you use, you may be able to access, change and update your information through an account created as part of the Services (e.g., a Digital Ordering Account). If you are a Guest and would like to have your account deleted or have other questions about your Digital Ordering Account, please contact support@ecashcloud.com. In certain cases, you can also submit a request for deletion of your Digital Ordering Account from directly within the mobile application.

In other instances, if applicable, see the instructions provided as part of the Services or contact us as described in the “How to contact us” section of this Statement. We may need to verify your identity before changing or correcting your information. In certain instances, we may not be able to make the correction or accommodate the request due to legal, contractual or technical restrictions.

Please note that depending on your status, location and applicable law, you may be entitled to additional information rights in relation to the processing of your personal information. For more information regarding these rights, and the locations/circumstances where these rights are available, please see the applicable addendums in this Statement.

B. Managing communications

As part of providing the Services, Ecash Software (whether directly or through a third party), may send you:

  • Marketing communications: Depending on the nature of our relationship and the Services being used, we may send you marketing and other promotional communications for new or existing Services that we think you might be interested in. These marketing communications may include marketing text messages if you have opted in to receiving them. You can opt out of or unsubscribe from any marketing communications by following the instructions in those messages, by changing your communications preferences within your account or through your device. You can also opt out by contacting us at info@ecashcloud.com. Opting out of one communication will not necessarily opt you out of all marketing communications.  Please note that you may still receive certain non-marketing communications after opting out. These messages may include transaction-specific communications, messages as part of a loyalty program or account-specific communications.

For Guests:

  • sending you digital receipts or other messages in relation to Services you engage with;
  • notifications sent by Merchants and/or third-party service providers as part of our Services, such as order status, delivery or pick up notifications and information pertaining to our reservation and waitlist services;
  • responding to feedback that you have provided in relation to the Services of Ecash Software;
  • account or program-specific messages as part of your use of the Services (e.g., loyalty accounts with our Merchants or by setting up a Digital Ordering Account); or
  • messages associated with contests, competitions or promotions that you have elected to participate in.

For Merchants and Merchant Employees:

  • messages relating to Ecash Software B.V.’s services and demo requests (for prospective Merchants);
  • on-boarding related messages pertaining to setting up the Services; or
  • messages pertaining to Services that you are using or are under your account.

In certain cases, depending on the nature of your relationship with Ecash Software B.V. and the Services being used, you may also receive messages from third-party service providers and business partners.

6. Security

We implement appropriate administrative, physical and technical security measures to reasonably protect your personal information against unauthorized access, disclosure, damage or loss. However, even though we have taken measures to protect your personal information, we cannot guarantee that the collection, transmission and storage of personal information will always be completely secure.

The Ecash Website, or other sites through which you may use the Services may contain links to other sites and/or resources over which neither Ecash nor Merchants have any control. Ecash makes no representations or warranties with respect to the content, ownership, or legality of any such linked sites. Links to third-party sites are provided solely as a convenience to you and should not be construed as an affiliation with or endorsement by Ecash or any Merchant of such third parties or any content, items, or services on third-party sites. Access and use of such other sites, including the content, items, or services on those sites, solely at the risk of the user, and Ecash has no responsibility or liability resulting from your access or use of such other sites. These linked sites may collect personal information from you when you enter their site. Any such collecting of information is not subject to the control of Ecash. To ensure protection of privacy, you should always review the privacy policies of the sites you visit when linking from a Ecash Website or any other site associated with the Services.

You may also contact the Merchant to which such questions, comments or concerns relate. Please review this Privacy Policy carefully. If you do not agree with this Privacy Policy, your ultimate choice is not to use the Services. Remember, by registering with Ecash or using any part of the Services (whether you registered for them or a Merchant registered you with Ecash), you accept and agree to the privacy practices described in this Privacy Policy.

Each Client has agreed that this Privacy Policy is incorporated by reference with the Merchant Terms, which govern their relationship with Ecash. Ecash is not responsible for assuring that Merchants comply with this Privacy Policy.

Ecash reserves the right to update this Privacy Policy at any time. If this Privacy Policy is materially changed, the revised policy, or a notice that the policy has been revised, will be posted on the applicable Ecash Website. You are responsible for periodically reviewing the Privacy Policy, and should do so frequently, especially before you provide any Personally Identifiable Information. When Ecash changes this Privacy Policy, we will also revise the “last updated” date at the end of this Privacy Policy. If Ecash updates this Privacy Policy, continued use of the Services (following the posting of the revised Privacy Policy) means that you accept and agree to the terms of the revised Privacy Policy. Ecash recommends that you periodically review this Privacy Policy.

In addition, the words “includes,” “including,” or any variation thereof as used in this Privacy Policy means “including, without limitation” and shall not be construed to limit any general statement that it follows to the specific or similar items or matters immediately following it
